WHAT IS FILING FALSE PUBLIC RECORDS IN LOUISIANA?

A person commits filing false public records when he/she files or deposits for record in any public office or with any public official, or the maintaining as required by law, regulation, or rule, of any of the following:

  1. Any forged document; or,
  2. Any wrongfully altered document; or,
  3. Any document containing a false statement or false representation of a material fact; or,

There are affirmative defenses to the crime of false public records.

PENALTIES FOR FILING FALSE PUBLIC RECORDS CONVICTION

A person who commits the crime of filing false public records may be imprisoned for not more than five years with or without hard labor or may be fined not more than $5,000.00, or both.

The court may also order restitution as a part of the sentence to the state if the state suffered a loss as a result of the offense. Restitution may include payment of legal interest.
